Thoughts on This Crash as a Car Accident Lawyer

Another fatal crash in Las Vegas that could have been prevented by following traffic laws and not driving while impaired. Looking into the legal aspects of this crash, the driver of the Volkswagen will face serious civil and criminal consequences.

First, analyzing the potential civil lawsuit, the driver will most likely face a wrongful death lawsuit for their negligence and recklessness that led to the death of the motorcyclist. In addition, the civil lawsuit will likely include punitive damages, which are meant to punish drivers for extremely reckless actions such as driving under the influence. These punitive damages will only increase the financial burden on the driver.

Now, looking at the criminal charges, the driver will be charged with a felony DUI due to it involving death, which will carry a minimum of 2 years in prison and fines from $2,000 to $5,000.
